Before founding MAR Law Group, Michelle spent a decade at Luis Rafael Rivera Law Office in federal and state civil litigation. She holds a J.D. from the Pontifical Catholic University of Puerto Rico School of Law and a B.A. in Business from the University of Puerto Rico.

33 F.4th 20 (1st Cir. 2022) · April 29, 2022
The First Circuit held that the district court abused its discretion by excluding the plaintiffs' medical expert as a discovery sanction. The court found the expert sufficiently established applicable standards of care, adequately explained the patient's conditions and medications, and that qualified uncertainty about a causation finding did not render the expert's opinion unreliable.
Allowed critical expert testimony supporting proof of medical negligence and causation.
U.S. Court of Appeals, First Circuit
23 F.4th 523 (1st Cir. 2022) · February 25, 2022
A medical malpractice wrongful death action in which the district court dismissed under the "prior pending action" doctrine due to a parallel state court proceeding. The First Circuit vacated and remanded, holding that Colorado River abstention — not the prior pending action doctrine — was the correct framework, and that the standard of review was abuse of discretion.
Clarified the proper legal framework and revived the plaintiff’s claim.

The Puerto Rico Supreme Court addressed the duty of hospitals to formulate, adopt, and enforce institutional policies ensuring patient health and welfare, as required by accepted standards of medical practice. The decision established that hospitals bear direct institutional accountability for the policies governing patient care.
